End-User Terms
/Effective: July 18, 2026. Provider: GMETI LLC (“HiveCare”, “we”)
HiveCare is a messaging app your care agency uses to communicate with you. Your account is created and managed by the agency, not by us. HiveCare is not an emergency service: in an emergency, call 911. We charge you nothing for this app and we make no decisions about your care. This document does not bind you to arbitration and does not take away your right to take part in a class action.
1. What this document is and who it applies to
These End-User Terms (“Terms”) are the agreement between you and HiveCare when you use the application as a client of a care agency, or as a family member or authorized contact of a client. By ticking the acceptance box in the app, you agree to these Terms.
If you are a member of an agency’s workforce (administration, nursing, caregivers), this is not your document: the Terms of Service published at hivecareapp.com/terms apply to you.
If you use the Service on behalf of someone in your care — a minor, or an adult you represent — these Terms bind you, and you represent that you are authorized to act for that person. You must be 18 or older to hold an account.
2. Your account is managed by the agency
Your agency creates your account, decides what you can see, who you can communicate with and for how long, and can deactivate it. HiveCare does not choose your caregivers, does not direct your care and does not decide what information is shared with you: we provide the platform your agency uses.
So if you want to correct your information, find out who has accessed it, obtain a copy, or stop using the Service, address the request to your agency, which is responsible for your record. If you send it to us, we will pass it on to the agency.
3. License to use
While your account is active we grant you a personal, limited, revocable, non-exclusive and non-transferable licence to install and use the app on devices you own or control, for the sole purpose of communicating with your care agency. You may not copy, modify, decompile, resell or transfer access, or use the Service to build a competing product.
4. Acceptable use
You agree to: use the Service lawfully and respectfully; not impersonate anyone; not attempt to access accounts, messages or information that are not yours; not introduce malicious software; and not bulk-extract information from the platform. Do not share your password. Tell us or your agency as soon as you suspect someone has accessed your account.
Other people’s information that you see in the Service is confidential: do not record, forward or publish it outside the app.
5. HiveCare is NOT an emergency service
Do not use HiveCare for a medical emergency or an urgent situation. In an emergency, call 911 (or your local emergency number) and then, if you wish, send a message in the app.
HiveCare messages are not guaranteed to be delivered or read, and are not delivered instantly. Nobody is required to be watching the application. A message may be delayed or lost because of network, device, notification or service failures. Do not assume that a message sent is a message read. If you need confirmation of something that cannot wait, use the telephone.
6. Not medical advice
HiveCare is a communication tool. It does not provide medical services or medical advice, diagnosis or treatment, does not replace the judgment of a healthcare professional, and makes no clinical decisions and does not assist in making them. HiveCare is not a medical device and is not certified electronic health record (EHR) technology. Decisions about your care are made by you and your agency.
7. Privacy
Our Privacy Policy explains what data we process and how. As to your health information, HiveCare acts as the agency’s technology provider (business associate) under a HIPAA agreement with it: the agency decides what is stored, who has access and how long it is kept.
The notice of your health-privacy rights — the Notice of Privacy Practices — is given to you by your agency, not by us.
8. No warranties
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we make no implied warranties of merchantability, fitness for a particular purpose or non-infringement, and we do not warrant that the Service will be uninterrupted, that messages will be delivered promptly, or that the app will work on any given device or network. Some states do not allow the exclusion of certain warranties; in that case the exclusion applies only as far as that state allows.
9. Limitation of liability
To the maximum extent permitted by law:
- HiveCare is not liable for indirect, incidental, special, punitive or consequential damages, or for lost profits or lost data.
- HiveCare’s total aggregate liability to you, for any cause relating to the Service, is limited to US$100 or the amount you have paid HiveCare directly for the Service in the preceding 12 months, whichever is greater.
Nothing in these Terms excludes or limits liability that cannot be excluded by law, including for wilful misconduct, gross negligence or fraud, or any rights given to you by the mandatory consumer-protection law of your state of residence.
This limit does not affect any claim you may have against your agency, which is the party providing your care.
10. Governing law and time limit for claims
These Terms are governed by the laws of the State of Colorado, USA., without prejudice to the mandatory consumer-protection rules of your state of residence and to your right to bring proceedings where you live where those rules guarantee it.
To the extent permitted by law, any claim relating to these Terms or the Service must be brought within one year of the event giving rise to it.
This document contains no arbitration clause and no class-action waiver, and you do not waive trial by jury. Before bringing a claim we ask — but do not require — that you write to support@hivecareapp.com so we can try to resolve it.
11. App stores
You download the app from Google Play or the App Store, and that store’s terms also apply. When you use the app on an Apple device: (a) these Terms are an agreement between you and HiveCare only, not with Apple; (b) the licence in section 3 is limited to Apple-branded devices that you own or control, as permitted by the App Store Usage Rules; (c) HiveCare, not Apple, is responsible for the app and its content; (d) Apple has no obligation to furnish maintenance or support; (e) if the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any, and to the maximum extent permitted by law that is Apple’s only warranty obligation; (f) HiveCare, not Apple, is responsible for addressing any claim by you or a third party relating to the app; (g) HiveCare, not Apple, is responsible for intellectual- property infringement claims; (h) you represent that you are not located in a country subject to a U.S. embargo and are not on any prohibited-party list; and (i) Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
12. Suspension and end of access
Your agency may deactivate your account at any time. We may suspend access immediately and without prior notice where there is a security risk, a credential compromise, use that endangers other people’s information, or a legal obligation requiring it; we will notify you as soon as reasonably practicable.
After access ends, retention and deletion of information follow the Privacy Policy and the HIPAA agreement with your agency. Sections 5, 6, 8, 9 and 10 survive.
13. Changes and contact
We may update these Terms; we will post the current version with its date and, for material changes, ask you to accept them again in the app. Earlier versions will remain accessible.
